-1- LEGAL TERMS

  

Users of CAPSULEBYESO.COM accept and agree to respect all the conditions included in this declaration.

  

If Users do not accept these terms, CAPSULEBYESO.COM reserves the right to ask the users to refrain from using CAPSULEBYESO.COM website.

  

The access and the use of the web CAPSULEBYESO.COM are for personal use only.

  

CAPSULEBYESO.COM provides Clients with information about products and the possibility of buying these goods.

  

The website CAPSULEBYESO.COM as well as the presented products belong to the company LOVE DELUXE SARL, company based in Lyon, France (registered address: 41-43 rue de la Bourse at Lyon (69002) - FRANCE), registered at the RCS of Lyon under the number 484 226 212 (intra-Community VAT number FR 52 484 226 212).

  

As retailer approved by all the present brands on the site, CAPSULEBYESO.COM guarantees the authenticity of all product.

  

-2- PAYMENT METHODS

  

CAPSULEBYESO.COM accepts the following forms of payment: credit card, bank transfer and PayPal.

  

CREDIT CARD

We accept Visa, MasterCard and American Express and other main credit cards.

  

CAPSULEBYESO.COM has integrated the international payment platform Stripe. Stripe allows our customers to easily pay with major credit cards around the world, to use digital wallets in the desired currency.

Stripe has the strictest level of certification available in the payments sector.

 

Your bank details are encrypted, according to the SSL (Secure Socket Layer) protocol and, never legibly transmitted on the network.

No banking data passes through CAPSULEBYESO.COM ensuring a 100% secure payment.

CAPSULEBYESO.COM does not have access to your card details and we do not store them on our servers.

  

Stripe also allows payments with mobile and also WeChat. 

  

PAYPAL PAYMENT

If you are a PayPal customer and already have an existing account, simply log in with your details and confirm your payment. If you do not have a PayPal account, you may open one and confirm the payment. In case of returned goods, the amount will be credited back to the account used for the payment.

  

BANK TRANSFER

In this case, CAPSULEBYESO.COM will send an e-mail confirmation to the customer with all details needed to complete the bank transfer. Customer have to send a copy of the payment by e-mail to customerservice@capsulebyeso.com within 48 hours from the e-mail with the confirmation order. Out of the time, if the email of the bank transaction is not received, the order will be cancelled.

The merchandise will be shipped once CAPSULEBYESO.COM has received the funds and the merchandise is available for shipment.

  

FIRST-TIME CLIENT

CAPSULEBYESO.COM can request our financial service providers to double check the transaction and account information. This verification process will delay immediate shipping.

CAPSULEBYESO.COM also reserves the right to ship the order only to the Billing Address and/or if necessary, to ask further evidence for first-time Client.

  

-3- PRODUCT AVAILABILITY

  

Selection available on CAPSULEBYESO.COM reflects the real availability of articles, by size and colour. The website is linked to the warehouses where all clothes, and data availability are therefore updated in real time.

  

Once the order is processed by the Orders Department, CAPSULEBYESO.COM reserves the right to confirm again the availability of the merchandise after verify transaction’s validity and check Client’s record with CAPSULEBYESO.COM. Clients will be informed if the item ordered is not available or if the order cannot be processed as per the Client’s request.

  

PRICES AND CURRENCY

Prices of Products are indicated in Euros (€) including all taxes (VAT), excluding contribution to the costs of processing and shipping fees if necessary. These charges and the amount due are brought to the attention of the Customer before validation of the order on the confirmation of order page. (See section Delivery)

  

The dispositions laid down in the tax code relating to VAT will be applicable.

For the orders ship off European Union and French Overseas Departments and Territories, the prices will be recalculated excluding VAT if you have chosen the country of destination when displaying the products or before validation order depending on the delivery address.

In this case, the Customer is considered as importer of Products.

In the case of customs duty requirements, import taxes or any other charges, applicable due to the geographical destination of the products, these charges will be incumbent on the Customer and fall within his/her entire responsibility, in terms of verification of the possibility of importing the Products as well as declarations and payments to authorities or competent organisations. It is therefore recommended to the Customer to ensure verifications of these aspects from relevant local authorities and to carry out any necessary procedures prior to the validation of the order.

All orders is delivered with an invoice in euros showing the exact total amount of purchase, in accordance with the rules governing international trade.

CAPSULEBYESO.COM ships worldwide with DHL Express.

  

COSTS

Shipping costs are free for all orders over € 300.00 (products on sales or with a promo code not included).

In others cases:

ORDER PROCESSING AND SHIPPING DATE

Orders are processed from Monday to Friday from 9 a.m. to 5 p.m. Order received from Friday to Sunday are processed the following Monday.

All orders received will be processed within 48 hours and dispatched upon Fraud-monitoring team confirmation which has the task to verify the authenticity of the payment received.

During sales or special promotions, processing times may be longer.

    

Delivery times:

European Union 1-2 working days

Rest of the World 3-5 working days

  

CAPSULEBYESO.COM shall not be responsible for delays in deliveries due by international customs, weather conditions and other circumstances beyond the control of CAPSULEBYESO.COM.

  

TAXES

According to the destination, the prices could be different.

  

For all the EU countries, the VAT is included in the product price.

  

For all the Extra EU countries, the VAT is not included in the final price and duties with taxes will be paid directly at the customs (DDU delivery).

  

DELIVRY

Upon delivery of the package, customers are asked to inspect it thoroughly before signing to confirm the delivery of the order. Goods become property of the customer by signing.

If for any reason the box looks tampered with, either sign for the package with reservations or refuse the package. In the event that the box has been signed for with an unauthorized signature or there is evidence that the package has been tampered with, open a claim immediately with the courier and contact CAPSULEBYESO.COM at customerservice@capsulebyeso.com.

All the Customers who make an order establish a commercial relationship with CAPSULEBYESO.COM and make consequently a commitment to accept the delivery of their parcel. If the package is not successfully delivered to the Client's address due to a lack of cooperation from the Client (wrong telephone number, wrong address, absent at address, non-compliance with import regulations), the package may risk being sent back to France at the Client's expense including any import fees that may be assessed upon come back to France. These fees will be deducted from any eventual refund.

  

-5- RETURN

 

For whatever reasons, all customers, who are not satisfied with the purchase, can return the item(s), unworn and not used, and they can ask a refund.

  

RETURN CONDITIONS

All products must return within 14 days from the delivery date. Products must be returned in their original packaging and in the same conditions they were originally dispatched: not worn, used, altered or damaged in any way. Shoes soles mustn't be altered in any way, with no signs of usury. All products must also be returned with all original tags and accessories, including tag authenticity and security seal that should not be cut or broken. Damaged returns will not be accepted and will be returned to the customer at his own expenses. Footwear and accessories must be returned with their original box, which is an integral part of the product.

RETURN PROCEDURE

To make the return, Customers must send an e-mail to customerservice@capsulebyeso.com within 14 days from the date of the delivery, stating the number of the order, return product codes, and reason for the return. Within 3 working days, customers will receive an e-mail confirmation from our Customer Service, with all the instructions to proceed to make the return. Customers must strictly follow these instructions. Returns must be in our warehouse within 10 working days after authorization. CAPSULEBYESO.COM reserves the right to inspect returned items to verify r integrity, and if it doesn’t meet the conditions requested, to return it at the customer's expenses.

  

REFUNDS

Refunds will cover only the prices of the returned items (i.e. not including shipping costs and custom fees)

CAPSULEBYESO.COM will endeavour to refund immediately the customer, however no later than 10 working days after the date of acceptance of the returned goods. The refund will be made on the same credit card or on the same account used by the customer for payment.

In the case of partial return of the order, the Customer, who may have benefited during the initial order by free delivery due to the order being over a certain amount, may be billed for the delivery costs corresponding to the effective delivery, if the amount is less than the limit for free deliveries.

Outside the EU, customs duties and sales taxes are non-refundable. You may be able to recover these costs by contacting your local customs bureau directly.

  

DEFECTIVE ITEMS

Defective products are items received manifesting defects of conformity. CAPSULEBYESO.COM reserves the right to reject not authorized faulty returns for faulty. In case of acceptance of the defective return, CAPSULEBYESO.COM will refund the purchase price and shipping.

  

-6- PRIVACY POLICY

We care about the protection of personal data and the privacy of our customers. The term "personal data" is defined by law and indicates "particular data about personal or material circumstances of an identified or identifiable person". These data include e.g. full name, postal address and e-mail address or other data related to an individual.

The company LOVE DELUXE SARL, 41-43 rue de la Bourse à Lyon (69002) – France – is Responsible for handling and data protection.

In any case, personal data, voluntarily provided by the User, will not be communicated nor sold to a third party.

  

All necessary information required for the payment will never be seen or stored for any purpose by CAPSULEBYESO.COM.

   

-7- APPLICABLE LAW, LITIGATION

   

Using the website, the User and CAPSULEBYESO.COM agree that the laws and regulations of French State will enforce any pertinent questions to the use of the website.

In the event of dispute, the French courts will be only competent.

The language of this contract is the French language. It is specified that this text is available in several languages. However, French version prevails in case of dispute about interpretation.

  

The present policy is valid from Janury 01, 2019. Changes and/or additions may be made by CAPSULEBYESO.COM also as a consequence of any subsequent changes and/or regulatory additions to the Privacy Regulations.
